    Nawaz’s legal team files protective bail to prevent him from being arrested

    The legal team of frmer prime minister and Pakistan Muslim League-Nawaz (PML-N) leader Nawaz Sharif has filed a bail petition in Islamabad High Court (IHC) to prevent officials from arresting him when he reaches Pakistan on October 21.

    Sharif was declared a proclaimed offender by IHC in the Avenfield and Al-Azizia cases due to non-compliance. After that, he went to London in November 2019 for medical treatment with the permission of the court.

    An accountability court sentenced Nawaz Sharif for 10 years in 2018 in the Avenfield and Al-Azizia references.

    His appeal against the sentence was rejected by an IHC bench comprising of IHC Chief Justice Aamer Farooq and Mohsin Akhtar Kayani for non-compliance.

    The Lahore High Court (LHC) suspended the sentence of the three-time former prime minister in Al-Azizia reference in 2019 because of his medical condition.

    Nawaz Sharif is also a fugitive in the Toshakhana case.

    His legal team has filed three protective bail applications, requesting that the IHC direct authorities not to arrest Sharif when he returns to country on October 21.

    After that, the court sent out a notice on Nawaz’s request for protective bail and requested an answer from the NAB by tomorrow.

    The Lahore High Court (LHC) has discharged Pakistan Muslim League-Nawaz (PML-N) leader Hanif Abbasi in the ephedrine quota case, as well as nullifying his lifetime sentence.

    A two-member bench announced the decision on the PML-N leader’s appeal against the sentence.

    In the last hearing, Justice Aalia Neelum and Justice Asjad Javed Ghural had reserved the judgement after hearing arguments from lawyers.

    Hanif Abbasi was sentenced to life imprisonment by a special court on July 21, just a few days before 2018 general elections for control of narcotics substance (CNS).

    In 2012, he and his co-accused were charged by the Anti-Narcotics Force (ANF) for misusing 500kg of ephedrine, citing Sections 9-C, 14, and 15 of the Control of Narcotics Substances (CNS) Act. He was contesting election in NA-60, Rawalpindi against main rival, Sheikh Rashid Ahmad of Awami Muslim League. However, he was disqualified after being found guilty in the case.

    The PML-N leader said in an appeal that the sentence was politically motivated, and there were eight suspects in case, but only the appellant got convicted. It was also mentioned in the appeal that the appellant didn’t misuse the ephedrine quota but the trial court ignored this fact and announced its decision.   

    “I was kept away from two elections (due to the case) and my daughter was also kicked out of her job,” Abbasi claimed. He also shared that his younger brother was kept in illegal confinement for 14 days.

    “If Sheikh Rashid contests the election, then the competition will be in the polls,” said Abbasi.

    The Pakistan People’s Party (PPP) has lifted up concerns about speculation that former prime minister and Pakistan Muslim League-Nawaz (PML-N) leader Nawaz Sharif will get “special relief” on his return to Pakistan on October 21.

    PPP’s Secretary General, Syed Nayyer Husain Bukhari, said in his statement on Monday that the PML-N supremo had been legally convicted by courts, stressing that Nawaz Sharif will have to face the law after his return to the country.

    “It is surprising [for PML-N] to hope that the judiciary will set a precedent of special relief for Nawaz Sharif,” he added.

    The PPP leader also said that the election is necessary for the prolongation of the parliamentary system in the country, demanding that the Election Commission of Pakistan (ECP) announce a polling date as soon as possible.

    “The PPP demands a level playing field for all,” he maintained.

    Former Prime Minister Nawaz Sharif’s legal team is gearing up to file three petitions seeking protective bail in the Avenfield, Al-Azizia, and Toshakhana cases.

    These petitions are expected to be submitted to the Islamabad High Court (IHC) as per sources of Dawn’s reporter Malik Asad.

    It is pertinent to mention that Nawaz Sharif is set to address a public gathering at Minar e Pakistan on October 21, after spending almost four years in the UK for his ‘medical treatment’.

    Nawaz Sharif had previously faced convictions in the Avenfield and Al-Azizia references, along with being declared a proclaimed offender in the Toshakhana case, which is currently being heard in an accountability court in Islamabad. During his time abroad, he had been granted bail in these cases.

    The decision to approach the IHC for protective bail appears to have been influenced by prior instances where the court had granted protective bail to individuals who were declared proclaimed offenders, including Sharjeel Inam Memon, Arbab Alamgir, and Asma Arbab, without the requirement of surrender beforehand.

    Sources close to the proceedings disclosed that there would be at least two court hearings – one before Nawaz Sharif’s return and another where he would surrender himself before the court.

    Following this surrender, he would be required to pursue pending appeals against his convictions in the Avenfield Apartment and Al-Azizia references, as well as address the ongoing Toshakhana vehicle case.

    The Toshakhana case, previously put on hold under NAB amendments, was reopened following a Supreme Court ruling to revive corruption cases.

    In 2018, Nawaz Sharif was convicted in two cases – the Avenfield Apartments and Al-Azizia references. However, he was acquitted in the Flagship reference. The late Judge Arshad Malik, who presided over the Al-Azizia reference, later claimed to have authored the judgment under duress.

    Pakistan People’s Party (PPP) leader Kursheed Shah criticised former prime minister and Pakistan Muslim League-Nawaz (PML-N) head Nawaz Sharif, alleging that he had engaged in negotiations with powerful quarters to come back to power.

    “If Nawaz Sharif comes to power by dealing with powerful circles at this age, then what would be left of his politics,” he asked rhetorically.

    “The red carpet for his return is not being rolled out by the PML-N but by someone else,” Shah added.

    Observing that despite facing a lot of problems, PML-N is still doing “backdoor politics”, Khursheed Shah stated that he told the PML-N chief that he was committing a mistake by climbing on “someone else’s shoulder” to come into power.

    The former leader of the opposition also questioned how a convict and fugitive could address a public gathering in Lahore.

    “This is a dangerous trap in which the PML-N is trapped. What was the difference between Pakistan Tehran-e-Insaf (PTI) chairman [Imran Khan] and Nawaz Sharif?”

    Shah asserted that Nawaz Sharif is being taken into power, just as PTI chief Imran Khan was given power in 2018.

    In a fiery political showdown, senior leaders of the Pakistan Muslim League-Nawaz (PML-N), Hamza Shehbaz and Ahsan Iqbal, launched scathing verbal attacks on the Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan on different occasions on Sunday.

    During a political rally in Kasur, Hamza Shehbaz fiercely criticized the PTI chief, citing his failure to substantiate corruption allegations against Nawaz Sharif and Shehbaz Sharif.

    Hamza accused the PTI chairman of concealing state gifts in the Toshakhana case, a scandal that has drawn considerable public attention.

    Hamza argued that Imran Khan forced the public to bear the burden of him violating the agreement with the International Monetary Fund (IMF).

    He praised Nawaz Sharif, saying, “In 1990, there was no motorway in Southeast Asia. At that time, Nawaz Sharif envisioned building a motorway from Islamabad to Lahore. The world praised the motorway project when it was completed.”

    Meanwhile, Ahsan Iqbal, another senior figure within the PML-N, branded the PTI chief as a “virus” during a workers’ convention.

    Iqbal said: “The PTI chief is an inept person who harmed the country during his tenure,” adding that the PTI had launched a campaign against the entire country.

    Recounting the tenure of PTI, Iqbal said, “PML-N leaders were jailed in fake cases. We faced bogus cases.”

    He stated, “The PML-N will start its election campaign across the country after October 21.”

    The district administration of Lahore has given permission to Pakistan Muslim League-Nawaz (PML-N) to hold a public gathering at the Greater Iqbal Park on October 21. Former prime minister and PML-N supremo, Nawaz Sharif, will address the gathering after reaching Pakistan at Minar-e-Pakistan on October 21.

    Lahore administration has said in its statement that PML-N had been told about the terms and conditions to hold the public meeting at Minar-e-Pakistan, while the former ruling party was also directed to ask for permission from the Parks and Horticulture Authority (PHA).

    The PML-N submitted a sworn statement to the Lahore administration to assure them that the party will pay in case of any damage to the park during the public gathering.

    The district administration has also emphasised its commitment to maintaining constant communication with relevant authorities regarding security, traffic management, and event organizers. An upcoming traffic plan and advisory will be released shortly to minimise any inconvenience for the general public.

    Former prime minister and Pakistan Muslim League-Nawaz (PML-N) head, Nawaz Sharif, who was in London since the last three years in self-imposed exile, performed Umrah in Saudi Arabia on Thursday.

    The PML-N supremo travelled from London to Saudi Arabia with his son Hussain Nawaz and close friends, to perform Umrah together.

    Nawaz Sharif will go to Dubai from the Kingdom, where he will stay for three days. After that, the former president will fly to Pakistan on October 21 to address a gathering at Minar-e-Pakistan. He will also explain his agenda to the people of Pakistan for the upcoming general elections.

    Sharif was accompanied on the Saudi visit by his close friend Mian Nasir Janjua, aide Waqar Ahmed, Karim Yousaf, and a few others.

    According to a report filed by Geo News, the flight carrying Nawaz home will be named ‘Umeed-e-Pakistan’. It can carry approximately 150 passengers.

    The Supreme Court (SC) has on Wednesday evening issued a verdict in favour of the SC (Practice and Procedure) Act, 2023, dismissing petitions challenging its validity.

    The decision was upheld by 10-5 majority. However, by an 8-7 decision, the majority of judges decided against the provision of law wherein retrospective right of appeal was given in the Act.

    Key Provisions of Act

    The act makes a number of significant changes to the way the Supreme Court operates. These include:

    • Requiring a three-member committee of senior judges, including the CJP, to approve all suo moto notices.
    • Establishing a transparent process for the formation of benches for hearing crucial constitutional issues.
    • Giving parties the right to appeal to the Supreme Court within 30 days of a final order from a lower court.
    • Requiring the apex court to hear applications alleging urgency or requesting interim relief within 14 days of filing.

    Reaction to the decision

    Former Prime Minister and President of _ (PML-N) Shehbaz Sharif welcomed the decision.

    “The Supreme Court’s verdict regarding the Practice and Procedure Act 2023 is a welcome step,” he wrote on X (formerly Twitter)

    Interestingly, when Asad Umar, PTI’s former secretary general, was asked about the judgment, he stated that it was the right decision but was intrigued to know if Nawaz Sharif would come back after the decision or not.

    “My question is, everyone is saying this is not a good judgment for Nawaz Sharif, why is Shehbaz Sharif liking this decision so much? I’m just asking an innocent question,” he said while talking to the media on Thursday morning.

    The verdict has caused a rift in the legal world. The decision, which involves Article 184(3), has led to intense discussions about what it means for the PML-N leader, Nawaz Sharif.

    As per Dawn, lawyer Mohammad Ikram Chaudhry explained that in cases where no review has been filed, it’s possible to request a “condonation of delay,” which means the court might accept an appeal or application even if it’s late.

    Mohammad Akram Sheikh noted that according to the law, a review must be requested within 30 days of the judgment. He mentioned that in some cases, the highest court has allowed for delays but stressed that the applicant would need to provide a valid reason for the delay.

    Senior lawyer Raja Inam Ameen Minhas mentioned that the Supreme Court Bar Association has an ongoing review petition against the disqualification of politicians. He argued that since the matter of disqualification is still under consideration, it’s “still appealable.”

    Barrister Zafarullah Khan, the former special assistant on law to the ex-PM, pointed out that the Supreme Court’s decision wouldn’t affect Mr. Sharif’s cases because he wasn’t seeking relief from the highest court. Instead, he intends to pursue his appeals against convictions, which would eventually reach the Supreme Court.

    Some lawyers believe that the decision is a setback for Nawaz Sharif, who recently planned to return to Lahore after spending four years in London.

    The decision declared Section 5(2) of an act as ultra vires, meaning that the lifetime disqualification in the Panama case remains in effect.

    Lawyer Abdul Moiz Jafferi questioned who really won in this matter.

    Lawyer Usama Khawar Ghumman argues that Nawaz Sharif and Jehangir Tareen can still contest elections.

    “Despite Supreme Court’s decision to strike down retrospective rights of appeal, Nawaz Sharif & Jehangir Tareen can, in the short run, contest elections due to the PDM-led Parliament’s amendment to Section 232 of the Election Act, 2017,” he wrote on X (formerly Twitter).

    Pakistan Muslim League-Nawaz (PML-N) head and former prime minister Nawaz Sharif will travel on a chartered plane to reach Pakistan from Dubai on October 21.

    According to a report filed by Geo News, the flight carrying Nawaz will be named ‘Umeed-e-Pakistan’. It can carry approximately 150 passengers.

    The former prime minister will leave Dubai for Pakistan on October 21, along with senior and close party members. Nawaz Sharif’s flight will land in Islamabad for a 30 minute long stay, with the PML-N supremo then flying to Lahore to address a gathering at Minar-e-Pakistan.

    Before the final leg of the journey, Nawaz Sharif will reach Saudi Arabia on Wednesday and perform Umrah there. He will stay in Saudi Arabia for a week and hold important meetings.

    Earlier, former finance minister Ishaq Dar said there is no chance of Nawaz’s arrest upon his arrival in the country.

    Dar also said that PML-N’s narrative will be about the economy, adding that, “recovery of the economy is the best revenge.”
